What are Arizona sex crimes consequences for Child Prostitution?

Child prostitution, minor is 15, 16, or 17 is defined as:

A person commits child prostitution:

  1. Causing any minor to engage in prostitution
  2. Using any minor for the purpose of prostitution
  3. Permitting a minor who is under the person’s custody or control to engage in prostitution
  4. Receiving any benefit for or on account of procuring or placing a minor in any place or in the charge or custody of any person for the purpose of prostitution
  5. Receiving any benefit pursuant to an agreement to participate in the proceeds of prostitution of a minor
  6. Financing, managing, supervising, controlling or owning, either alone or in association with others, prostitution activity involving a minor
  7. Transporting or financing the transportation of any minor with the intent that the minor engage in prostitution.

Child prostitution carries a mandatory prison term of 7 years to 21 years if offense if committed before July 24, 2014. Prison term is 10 years to 24 years if offense if committed after that date. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory for this offense.

Child prostitution, the minor is under the age of 15 is defined as:

A person commits child prostitution:

  1. Causing any minor to engage in prostitution
  2. Using any minor for the purpose of prostitution
  3. Permitting a minor who is under the person’s custody or control to engage in prostitution
  4. Receiving any benefit for or on account of procuring or placing a minor in any place or in the charge or custody of any person for the purpose of prostitution
  5. Receiving any benefit pursuant to an agreement to participate in the proceeds of prostitution of a minor
  6. Financing, managing, supervising, controlling or owning, either alone or in association with others, prostitution activity involving a minor
  7. Transporting or financing the transportation of any minor with the intent that the minor engage in prostitution.

Child prostitution carries a mandatory prison term of 13 years to 27 years. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory.

Child prostitution engaging in prostitution with minor under 15 and defendant at least 18 years of age is defined as prostitution means engaging in or agreeing or offering to engage in sexual conduct under a fee arrangement with ant person for money or any other valuable consideration. Child prostitution carries a mandatory prison term of 13 years to 27 years. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory.

Child prostitution engaging in prostitution with minor, who defendant knows is 15, 16, or 17, defendant at least 18 years of age is defined as: prostitution means engaging in or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration. Knowledge that the minor is 15, 16, or 17 is a required element. For offense committed prior to July 24, 2014 defendant would be subject to an enhanced sentencing range if he has one historical prior felony conviction for a violation of this section, as of July 24, 2014 defendant is subject to an enhanced sentencing range if he has one historical prior felony for any felony offense. Child prostitution carries a mandatory prison term of 7 years to 21 years and if convicted with prior, prison term is 14 to 28 years. Probation is NOT eligible for this offense. Registration as a sex offender IS mandatory.

Child prostitution engaging in prostitution with minor who is 15, 16, or 17, defendant has NO knowledge is under 18 is defined as, prostitution means engaging or agreeing or offering to engage in sexual conduct under a fee arrangement with any person for money or any other valuable consideration. Defendant need not have knowledge that the minor is 15, 16, or 17. Probation IS eligible but not a lifetime term. Registration as a sex offender is NOT required but court can order registration if a finding of sexual motivation is made.
