What are consequences for failure to register as a Sex Offender?

Failure to register as a sex offender is described as a person who is required to register within ten days after the conviction or adjudication or within ten days after entering and remaining in any county of this state, shall register with the sheriff of that county. Probation Is eligible up to a lifetime term. Registration as a sex offender may NOT be required, dependent on original conviction.

Failure to notify Sheriff of a change of residence, address, name is defined as failing to notify the Sheriff in person and in writing of a change of a:

  1. Change in residence within the county (residence is dwelling place, whether temporary or permanent)
  2. Change of address (location where person receives mail)
  3. Change in name

The defendant must have “actual knowledge of the need to register” or “proof of the probability that he had knowledge of the requirement” to be convicted of this offense. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.

Failure to register every 90 days, if no residence or if more than one residence is defined as failing to register with the Sheriff in person and in writing no less than every 90 days if:

  1. Transient
  2. If more than one residence

The defendant must have “actual knowledge of the need to register” or “proof of the probability that he had knowledge of the requirement” to be convicted of this offense. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.

Failure to verify address is defined as a person who is required to register shall verify the person’s address if requested by the department of public safety pursuant to section 13-3827 subsection G, which requires DPS to annually verify the addresses of all sex offender registration records contained within the Arizona criminal justice information system.

Failure to obtain or renew identification card is defined as on the person’s initial registration date, and every year after the person’s initial registration, the person shall obtain a new driver’s license or nonoperating identification, valid for one year. Probation IS eligible but no more than 3 years. Registration is PROBABLY NOT required

Failure to confirm online identifier is defined as, on the person’s initial registration date, and every year after the person’s initial registration, the person shall confirm any required online identifier and the name of any website or internet communication service where the identifier is being used. Required online identifier is means any electronic email address information or instant message, chat, social networking or other similar internet communication name, but does not include a social security number, date of birth or pin number. Probation IS eligible up to a lifetime term for this offense. Registration as a sex offender IS mandatory.

 Failure to notify Sheriff of a change in online identifier is defined as a person required to register as a sex offender shall notify the sheriff whether in-person or electronically within 72 hours after a person makes any change to any required inline identifier, and before any use of a changed or new required online identifier to communication on the internet. Required online identifier means any electronic email address information or instant message, chat, social networking or other similar internet communication name, but does not include a social security number, date of birth or pin number. Probation IS eligible up to a lifetime term. Registration as a sex offender IS mandatory.

Failure of employee or student at post secondary educational institution to notify the Sheriff of a change in employment status or enrollment status is defined as a student or employee of a post-secondary educational institutional who is required to register shall also notify the Sheriff of each change on enrolment or employment status at the institution. Probation IS eligible for this offense up to a lifetime term. Registration as a sex offender IS mandatory.
